Father who police say beat peeping Tom to face charges

9-6-2013 New Mexico:

Suspect still in hospital, will also be charged

The father who police said beat a man who was allegedly peering into his daughter's bedroom window will be charged.

They said the accused peeping Tom suspect was so badly beaten, he's in the hospital.

On Friday, outraged neighbors came to that father's defense.

"We've got a father, a young father, who could lose everything because of this one person," said Michael Salter.

That one person has been identified by police as 29-year old Dylan Maho, who police said was found naked around 2:30 a.m. Thursday morning outside a young girl's window, looking in, and making noises.

"It was moaning and groaning, that's what she thought she heard at first," said the girl's aunt Thursday. "She thought it was a cat."

"You can see that I'm starting to shake, and I'm not wanting to speak about it much more," Salter said.

The girl's father, Emilio Chavez III, his son, and his son's friend all ran after Maho.

The family said Maho threw the first punch.

In the eyes of the law, Chavez committed a crime. Police said he'll be charged with aggravated battery, a felony.

Some neighbors can't believe it.

"There's a naked man outside his daughter's window," said neighbor Bill Morang. "I think he was well within his rights chasing him down and beating him."

APD said the aggravated battery charge against Chavez was made based on recommendations from the District Attorney's Office, and that the office had been working closely with the police since the beginning of the investigation.

At the time of the incident, Chavez was questioned and released.

Maho will also be charged with felony voyeurism when he is released from the hospital.

Police said he has been upgraded to stable condition. ..Source.. by Anna Velasquez

What the Justice System Did to This Father After He Beat Up a Naked Peeping Tom Outside His Daughters’ Window Has Neighbors Fuming

Some are finding it hard to believe that a father who beat up a naked peeping Tom outside his daughters’ window is now facing charges.

According to KRQE-TV, Emilio Chavez III of Albuquerque allegedly beat Dylan Maho so badly after he found the man naked outside his home that he has been charged with aggravated battery. Maho had to be taken to the hospital in critical condition but is now stable.

The incident occurred Thursday around 2:30 a.m. when family members heard something outside of the 13 and 15-year-old girls’ window.

“The bushes were shaking. Then she heard groaning and moaning,” the teenagers’ mother Katrina Chavez told KRQE. “My oldest son went out, said ‘What are you doing?’ and then discovered he was naked.”

A 911 call was made, but when police arrived they found that the girls’ father, brother and a friend had apparently chased Maho down the street. When police found Maho, he had been beaten.

“We have a lot of concerns when victims provoke any kinds of attacks or pursue their attackers even if it’s with good reason, for instance in this situation where you have your children being victimized,” Albuquerque Police Department Officer Tasia Martinez told KRQE.

We’ve got a father, a young father, who could lose everything because of this one person,” neighbor Michael Salter told KOAT-TV, expressing his disbelief at the situation.

The neighbors also noted to KRQE that they had been trying to shield their children from sex parties Maho had been throwing at his home only a couple doors down. The local news station did find invitations online to such parties that match Maho’s address.

Morang said neighbors call him “the nudist” and noted that after the weekend they occasionally find condom wrappers in the street, according to KOB-TV.

“I would’ve done a little worse than what happened to him and I think any man or dad would do the same,” Morang continued. “I feel bad for the other guy and I hope nothing bad happens to him for protecting his family. I think he did what’s right.”

Once in better condition, police are expected to charge Maho with voyeurism, which is a fourth degree felony when committed against victims who are minors.

Chavez’s aggravated battery charge though could be a third degree felony if “great bodily harm” was inflicted.

Speaking with KRQE, Chavez said he was so angry, he doesn’t remember chasing down Maho and that he wishes he didn’t beat him so badly. The station noted Chavez having a criminal record for child abuse and domestic violence. ..Source.. by theBlaze

APD: Badly-beaten peeping tom still in hospital

9-20-2013:

Prowler identified, charged with felony voyeurism

A severely-beaten, alleged peeping tom is still in the hospital. The prowler has been identified as 29-year-old Dylan Maho. He has been charged with felony voyeurism.

Police said he was beaten severely and may have been unconscious for most of the beating.

In the 911 call, a mother expressed her concern for her daughters, and what unfolded afterwards, saying, “There was a guy outside our window and he was chasing my son.”

“Ma’am, you need to calm down. I can’t understand you,” replied the dispatcher on the call.

“Ma’am, there was a guy outside our window. A pervert looking at our daughters naked,” replied the mother. The girls are 13 and 15 years old.

After Maho peered through the window, the woman’s husband and son went after him. “My husband knocked him out. He’s naked. Oh, my God,” said the mother on the call.

The incident occurred in early Sept. in southwest Albuquerque. When officers arrived on scene, a nude Maho had been severely beaten.

“Where’s the male now?” asked the dispatcher on the call. “The man is on the (ground) knocked out. My husband knocked him out. Oh, my God,” the mother replied.

Immediately following the incident, Maho was in critical condition.

Albuquerque police are still finalizing their report on the incident. Once it's complete, the district attorney will decide whether the case against the father will go to a grand jury. ..Source.. by Regina Ruiz

Accused peeping tom enters plea

10-18-2013:

The accused peeping tom who was beaten nearly to death by a father pleaded not guilty Friday in court.

Dylan Maho was caught naked outside the bedroom of two teenage girls on Corriz Street in September.

He was chased down by the girls’ family members and beaten so badly, investigators were afraid he would not live.

The district attorneys office has said charges are possible against the father of the girl who played the biggest role in the beating.

It will likely go to a grand jury, but a date has not been set. ..Source.. by Kim Vallez
